agree  Daniel Pankovics (X): Utána olvastam a neten, angol oldalakon, és ezt használják leggyakrabban. A "probate"-et főként olyankor láttam, ha végrendelkezésről van szó, pl. "probate of will", azaz a végrendelet bírósági jóváhagyása, megerősítése.

Explanation:
Szerintem a "probate hearing" a megfelelő kifejezés a magyar jog által alkalmazott "hagyatéki tárgyalás" fordítására.
Ajánlom a lent megadott linkeken az "estate", és a "probate estate" definícióit, abból elég jól kiderül, hogy az estate az elhalálozott teljes vagyonára utal, de ez két csoportra osztható, az egyik az, amelyik a törvény szerinti öröklési eljárás alá tartozik "probate estate", a másik pedig amelyik nem "non-probate estate". A definíciók nagyon jók, lásd lent.
Én azt hiszem, hogy a magyar hagyatéki tárgyalás az első csoportba tartozó hagyatékrészre "probate estate" vonatkozik, vagyis a tárgyalás a "probate hearing". A hagyatéki bíróság a "probate court" lenne.

Az "estate hearing" inkább arra vonatkozik, amikor valaki vitatja magát a hagyatékot, kivételt akar az eljárás alól, meg akarja változtatni a határozatot (pl. ha a hagyatéki határozat végrehajtása őt különösen nehéz helyzetbe hozná, stb.), akkor kérhet ilyet.
