Legalese is always tricky.
We must be extra careful whether to translate something into a present tense (the power is granted) or a certain future (the power shall be granted) since Indonesian does not have tense indicators.
Here, I believe, the text says that it is mandatory to grant the power even if in the future, there will be a provision to the contrary.
