I wish to know whether it is permissible to make the marriage contract/nikâh several months

(4-6 months) to the actual wedding party without having intercourse (dhukûl) - if one has a

mutual agreement not to have intercourse before the actual wedding party as such but

intending to get to know one another better and being allowed to be alone and talk

intimately without a third person present (having obviously made the decision to get

married, but not being able to due to several factors to throw a wedding party just yet).

Wa ‘Alaykum al-Salam


The marriage contract in Islam is very simple; the two parties express their decision to get

married to each other with an offer and acceptance, and two witnesses must be present.

Whether the marriage is actually consummated that night or the next has nothing to do with

the actual marriage contract and depends wholly on the decision of the two parties. There is

therefore no problem whatsoever to have the marriage contract several months before the

couple starts living together. In fact this is a superior course of action for several

reasons.


Often people who are merely engaged will develop quite a friendly relationship with each

other through telephone conversations, emails and even nights out. All of this is absolutely

prohibited as the two are still considered strangers and the fact that they have decided to

marry each other does not lift this general prohibition.

A marriage contract enables the two to undertake any means of communication that they like

and allows them to get to know each other which will ease the transition to married life and

show up unexpected obstacles before they occur so that the couple can tackle them.
