Brunetto Latini parla dei podestà comunali nella seconda parte del terzo libro del Tresor, scritto tra il 1260 e il 1266, distinguendo preliminarmente due forme diverse di governo temporaneo ed elettivo. La prima, diffusa in Francia e in "autres païs", è rappresentata da maires, prevosti, balivi e scabini, "ki sont sozmis a la signorie des rois et des autres princes perpetueus"; la seconda, quella podestarile, è tipica dell'Italia, e solo ad essa è dedicata la trattazione: "li citain et li borgois et li communité des viles eslisent lor poesté et lor signour tel comme il quident qu'il soit plus proufitables au commun preu de la vile et de tous lor subtés" (Li livres dou Tresor, a cura di F.J. Carmody, Berkeley-Los Angeles 1948, III, 73, p. 392). Un riscontro viene dall'arcidiacono dalmata Tommaso da Spalato, che narra a distanza di decenni alcuni avvenimenti accaduti nella sua città nel 1238. In quell'anno si importò a Spalato dalla penisola l'istituzione podestarile, un "regimen Latinorum" costituito "ad exemplar Ytalicarum urbium" (Artifoni, 1995). I due autori ci dicono che nel pieno Duecento il governo dei podestà ‒ elettivo, temporaneo e teoricamente non soggetto ad altri poteri ‒ è un carattere inconfondibile della civiltà urbana d'Italia. Queste testimonianze parlano della forma matura dell'istituto, che si può ritenere compiuta non prima del secondo o terzo decennio del sec. XIII. Ad essa si giunse attraverso un percorso storico sulla cui interpretazione le ricerche sono aperte.
