Fatto salvo il valore dirimente delle argomentazioni che precedono, l'esponente precisa che la clausola compromissoria per "arbitrato rituale" contenuta nel contratto preliminare del ... difetta del requisito della specifica sottoscrizione ai sensi dell'art... con la conseguenza che la stessa non può trovare applicazione in quanto gravata da nullità assoluta.
La suprema Corte di cassazione ha chiarito infatti che la clausola compromissoria per arbitrato irrituale non rientra fra quelle da approvarsi....
