De begrippen ontvankelijkheid en toelaatbaarheid zin in het gerechtelijk recht synoniemen. Deze begrippen kunnen dus door mekaar worden gebruikt en dekken mekaar inhoudelijk volledig.

Alvorens over een vordering te oordelen zal de rechter de rechtmatigheid van de uitoefening van de rechtsvordering nagaan en ingeval van vaststelling van rechtmatigheid van de vordering, deze toelaatbaar verklaren en een afwezigheid daarvan ze ontoelaatbaar of onontvankelijk verklaren.

De term "onontvankelijkheid" of "ontvankelijkheid" wordt evenwel verkozen boven de term "toelaatbaarheid" of "ontoelaatbaarheid". De term ontoelaatbaarheid heeft een bijklank alsof de vordering onkies, onduldbaar of ongeoorloofd zou zijn, en nochtans is de toelaatbaarheid onontvankelijkheid een louter technische kwestie.
