Italian term or phrase: atto giudiziario estero
I know this certificate is some sort of summons/writ type letter from the criminal records office of a County/District Court. I don't know if the "estero" is implying from or to the foreign country (i.e. Is it referring to Italy or England?). Complete sentence reads:

"Oggetto: atto giudiziario estero da notificare a [name of Italian person living in UK]"

My attempt is:

"This summons from abroad is served to [Italian person]"

Is this the correct wording and meaning?

La struttura del processo civile statunitense

La struttura del processo civile statunitense in primo grado può essere sinteticamente ricostruita nelle seguenti fasi:

filing e service of process
pre-trial discovery
trial
judgment
enforcement.
Il filing è il deposito dell'atto introduttivo del giudizio presso la corte competente, che dà avvio alla causa. Successivamente al deposito, l'atto dev'essere notificato al convenuto entro un certo termine (service of process).

Scambiati i primi atti difensivi (pleadings), si apre la fase di ricerca delle prove. E proprio qui si rinvengono le maggiori differenze tra il sistema americano e quello italiano (e di buona parte dei Paesi europei).
Infatti, negli U.S.A. la discovery è gestita pressochè interamente dalle parti e dai loro avvocati. Ciascuna parte (tramite il proprio avvocato americano) richiede direttamente all'altra di fornirle i propri documenti e di rispondere ad interrogatori scritti, mentre gli avvocati di ciascuna parte sentono direttamente i testimoni dell'altra parte, alla presenza dei legali di quest'ultima (i quali hanno il diritto alla cross examination, ovvero al controinterrogatorio del proprio teste).
Il giudice ha essenzialmente la funzione di controllare la regolarità del procedimento, fissando udienze interlocutorie a tale scopo.
