La Societa' non può che respingere nella maniera più ferma e decisa tutte le contestazioni sollevate nei suoi confronti e, preso atto del VANO SPIRARE del termine per l’adempimento concesso nella missiva del 15 novembre u.s., si ritiene libera di assumere ogni iniziativa per la migliore tutela dei propri diritti in tutte le sedi competenti.

This is in one of a number of letters between lawyers about an alleged breached of contract. Plenty of google hits for vano spirare, usually also to do with a 'termine', but I can't quite get the sense of it. Thanks for any help.

The fact that it expired "in vain" means that there was no performance.

To reinforce this point, you could add "without the required performance" pr something similar, but I would say that it is not necessary.

Personally, I feel that 'vano' is redundant in this case and should not be translated. However, if a translation is required, the expression 'upon fruitless expiry' is used in English:
