Italian term or phrase: l’aggressore si sia introdotto oppure 'si sia trattenuto' nell’abitazione altrui
Più precisamente, il comma 2 dell’art. 52 c.p. sancisce una presunzione di proporzione iuris et de iure tra pericolo di offesa nei confronti dell’aggredito e reazione difensiva allorquando il pericolo venga realizzato nell’ambito del privato domicilio e l’aggressore si sia introdotto oppure si sia trattenuto nell’abitazione altrui, o in altra privata dimora o nelle appartenenze di essa, contro la volontà espressa o tacita di chi ha il diritto di escluderlo ( oppure con inganno o clandestinamente), mentre il comma 3 dell’art. 52 c. p. estende tale disciplina a qualsiasi altro luogo ove sia svolta un’attività commerciale, professionale o imprenditoriale; la proporzione, tuttavia, è presunta purchè la reazione difensiva sia compiuta al fine di difendere: a) la propria o l’altrui incolumità ; b) i beni propri o altrui, se non vi è desistenza e risulta presente un pericolo di aggressione.


More precisely, paragraph 2 of article 52 of the penal code sanctions a presumption of proportion iuris et de iure between the danger of violation towards the victim of the attack and a defensive reaction when the danger is committed in the private domicile’s sphere and the aggressor got inside or kept himself/herself in other people’s residence, or in another private residence or in its belongings, against the expressed or tacit will of whom has the right of excluding it (or by deceit or clandestinely), while paragraph 3 of art 52 of the penal code extends the discipline to any other place where a commercial, professional or entrepreneurial activity takes place; the proportion, however, is supposed, provided that the defensive reaction is made in order to defend: a) one’s own and other people's safety b) one’s own or other people’s assets, if there is not desistance and we are in presence of a danger of aggression.
