In forza di detta delega è stato emanato il decreto ministeriale n. 352 del 1° settembre 1998 il quale, dopo avere esposto l’ambito di applicazione e dettato i criteri per la corresponsione degli interessi legali e della rivalutazione monetaria, ha precisato che tali somme accessorie sono corrisposte d’ufficio, fermi restando gli ordinari termini di prescrizione e che le somme stesse “decorrono dalla data di maturazione del credito principale, ovvero dalla scadenza del termine previsto ai sensi dell’art. 2 della legge 7 agosto 1990 n. 241, per l’adozione del relativo provvedimento e sono dovuti fino alla data di emissione del titolo di pagamento, da comunicare all’interessato nel termine di trenta giorni”.
