Dans sa définition la plus simple et la plus répandue, il y a concession de service public lorsque le contrat confie à un tiers la charge d'exécuter un ouvrage public ou d'assurer un service public, le concessionnaire étant rémunéré par l'exploitation de l'ouvrage ou la gestion du service, par l'intermédiaire de la perception d'une redevance sur l'usager.
