Explanation:
治験との因果関係が無ければ，補償責任・賠償責任は生じない→それは単なる偶発事象
＊補償責任は絶対責任（結果責任absolute liability）ではない
􀂄賠償責任（legal liability）とは、違法性を前提とした責任（民法709条や同415条に抵触する法的責任）
􀂄補償責任（compensation）とは、適法行為にかかる被験者に生じた損失補填（社会的救済）の問題

GCP省令で言う補償責任（compensation）は、絶対責任（absolute liability）ではありません。
賠償責任（legal liability）が違法性を前提とする責任であるのに対し、補償責任とは適法行為に係る損失補てん、社会的責任の問題です。

Explanation:
actual damages versus general damages might work as well, but statutory and nominal seem a good fit because of the distinction between necessary determination of illegality included in the page you reference.
