著作権者:copyright holder

前項の場合において、当該著作物の原著作権者がであった場合も、はかかる譲渡後、当該著作物における著作者人格権を行使しないものとし、。。。。
So, in the case where stated on the last clause, enen if the original copyright holder of such copyrighted work were乙, 乙shall waive the moral right for the copyrighted work…

so, 乙 can not use his/her moral right on his/her copyrighted work.

I hope it helps.
Good luck for your translation!

1. original copyright holder 2. does not exercise his/her moral rights

Explanation:
Basically the same as above, except that the moral rights cannot be waived(譲渡不可能 http://ja.wikipedia.org/wiki/著作権). So the contract asks the copyright holder not to "exercise" his/her moral rights (http://www.jasrac.or.jp/profile/copyright/person.html).
Furthermore, the "moral rights" are a civil law invention and not completely accepted in common law jurisdicitions such as the United States (http://en2.wikipedia.org/wiki/Moral_rights).

Good luck!
