Mongolian term or phrase: баривчлах - хорих
OK now I am thoroughly confused. I'm working on paragraph 192 of the Criminal Code of Mongolia (I'm translating into Swedish but I'm using English as a reference.) The mongolian text has ... зургаан сар хүртэл хугацаагаар баривчлах, эсхүл хоёр жил хүртэл хугацаагаар хорих ял шийтгэнэ.
I already know the meanings of the two words, and they are easy enough to find in a dictionary. But I wonder if I'm missing something. How is 3-6 months of баривчлах ял equivalent to 2 years of хорих ял? Does баривчлаx have a meaning I'm not aware of or am I reading the text wrong? The English has incarceration and imprisonment, but as far as I understand the two are basically the same. At least in Swedish. Туслаач!

The difference is in the application of the penalty. "баривчлах" penalty is served at the detention center, while "хорих" sentence is served in the prison. Besides, the term of "баривчлах" penalty is shorter than "хорих" sentence.
The provision of the law doesn't say that these are equivalent sentences, but states that one of them will be imposed depending on the aggravating/mitigating circumstances of the crime/offense committed.
