Explanation:
het ambt van gerechtelijk stagiair is een afzonderlijk ambt waartoe een bijzonder examen toegang geeft en waarin de geslaagde voor drie jaar, kan benoemd worden. De gerechtelijk stagiair is geen magistraat. Hij kan tot magistraat benoemd worden indien er vacante betrekkingen zijn. Het adviescomité brengt op het einde van de stage een advies uit en de wet bepaalt dat indien de stageverslagen het comité ertoe brengen een ongunstig advies te geven, de stagiair door het comité wordt gehoord. Wanneer een stagiair na de volledige stage te hebben doorlopen een negatief advies krijgt en hij niet voor benoeming wordt voorgesteld, wordt hij niet ontslagen in de zin van artikel 259ter, § 2, van het Ger. Wb., maar is zijn stage enkel beëindigd.
