First of all, the legal status of outer space is
similar to the high seas - open to all
and the possession of none. In this
sense, the legal differentiation
between outer space and sovereign
air space is analogous to the differentiation
between the high seas and
sovereign territorial waters. Although
space is defined with reference to an
orbit, rather than point in which the
atmosphere transits into the vacuum
of outer space, it is an issue that may
emerge in the future, especially as a
function of growing commercial
exploitation. Here, one could potentially
see reference made to “exclusive
economic zones” as in law of the
sea in the context of orbits and con-
stellations. One can expect further
developments in international law
governing outer-space, and it is possible
that the law governing the “high
seas” could also become the template
for legally defining belligerent rights
in space.
