agree  Tomasz Poplawski: zdecydowanie tak, przynajmniej w USA; ew. "reserves the issue"; nie oznacza to odroczenia, lecz pozostawienie kwestii bez rozstrzgnięcia; tak jest np. ze sprawami majątkowymi w rozwodach, gdy jedna strona nie zjawia się.

disagree  darotob: Zdecydowanie nie. Reserve zakalada ze sad moze do sprawy wrocic pod tym samym docketem. Nie orzekanie to decyzja ostateczna dla konkretnej sprawy i wracac do niej nie mozna res judicata.
