Uzasadnienie postanowienia sądowego:
Zgodnie z art. 117 § 5 kodeksu postępowania cywilnego, sąd może ustanowić stronie pełnomocnika procesowego z urzędu, jeżeli uzna jego udział w procesie za potrzebny. o takiej potrzebie można mówić, gdy spełniona zostanie przesłanka przedmiotowa (...) lub przesłanka podmiotowa w postaci nieporadności strony wnoszącej o ustanowienie pełnomocnika z urzędu, niezdolności do samodzielnego podejmowania czynności procesowych w sprawie i niemożności ...
inny fragment:
... z podejmowanych przez niego w toku postępowania działań nie wynika, aby był on osobą nieporadną lub nie posiadającą orientacji w sprawie.
Czyli jest to termin prawniczy, ale ja nie mogę znaleźć takiego terminu w rejestrze prawniczym. Proszę o pomoc.
