Polish to English translations [PRO] Law/Patents | | Polish term or phrase: umowa o dzielo; umowa zlecenie | | What is the difference in English between the two types of contracts? Please give me the names in English. |
| | | contract for specific work; mandate (contract) | Explanation: These two types of contracts are regulated under, respectively, Titles XV and XXI of the Polish Civil Code.
Art. 627 thereof specifies in very general terms that "As a result of a contract for specific work the contractor undertakes to carry out a specific work....", while Art. 734 specifies that "By the contract of mandate the contractor undertakes to perform a specific legal transaction for the principal." When differentiating between the two (which has important tax and social security implications) the emphasis is on the definition of "specific work" the criteria of which need to be met in order for a contract to be named "umowa o dzielo". Generally speaking, the tax treatment of "dzielo" is more favorable than that of "zlecenie".

7 hrs Work For Hire
Explanation: It is a very specific term used (at least in U.S.) for praca na zlecenie.
It is often referred to as Work Made for Hire.
Work or Project (Dzielo) for Hire usually indicates that the institution or person that hires will have perpetual rights, but not the obligation, to use and license the use of person's name in connection with the work. All intellectual properties, including copyrights and trademarks, resulting from these services are works made for hire and all rights are vest in the institution o person that hires.
