IMHO - w slownikach jest troche zamieszania w tym temacie. ;)
Prawo polskie: wyroznia sie dwie formy upadlosci: ukladowa i likwidacyjna.
Prawo niemieckie: w razie niewyplacalnosci dluznika mowi sie o Insolvenzverfahren, w ktorym mozna zdecydowac sie na Sanierung lub Vergleich (upadlosc ukladowa) - mowi sie wtedy o Sanierungs- lub Vergleichsverfahren; Insolvenzverwalter moze jednak podjac decyzje o ogloszeniu upadlosci likwidacyjnej - w tym przypadku 'Konkurs' (Konkursverfahren wird eröffnet oder abgewiesen mangels Masse), ktore ma na celu likwidacje firmy.
