"Supremo Tribunal Administrativo tem entendido (vide Acórdão de 19.11.2008, Proc.0 n.° 0325/08 in www.dqsi.ptV que "quando uma determinada conduta constitui um facto qualificado por lei como ilícito, deverá fazer-se decorrer do preenchimento da hipótese normativa, por ilação lógica, a existência de culpa, na forma pressuposta na previsâo do tipo de ilícito respectivo."
