O dia 26 de Agosto foi apenas um ponto de partida, porque depressa se viu que a Assembleia Francesa havia proclamado unicamente os direitos, aos Varões Brancos. Parecia que o sufrágio universal deveria desprender-se da igualdade dos direitos, afirmada no artigo 1 da Declaração. A Assembleia Constituinte estabeleceu, mediante a Lei de 22 de Dezembro de 1789 o SUFRÁGIO CENSITÁRIO: “Só os proprietários varões têm direito de voto”. A negociação dos direitos políticos aos varões de cor, levantou uma nova contradição.
