Thank you for correcting my slip. I have to be fairly uncreative with this text as it is part of a due diligence procedure. What I am say is that the phrase after the comma is a definition of serious breach.

(1) “DE INCUMPRIMENTO” is missing: “para determinadas situações DE INCUMPRIMENTO” = … in specific circumstances related to incompliance/failure to comply? and
(2) Are you saying that "serious breach" equals to "reiterated breach(es)?" What if breach “light” (as in “Cola light”) occurs repeatedly, does it amount to be serious enough for eth contact to be rescinded? I'd go with serious OR repeated (breach).

This is how I propose to translate the source text.
Without prejudice to the special rules applicable in specific circumstances, either party shall be entitled to rescind this contract on the grounds of serious breach of contract, i.e. reiterated breach by the other party of its obligations.

It’s not “reiterar DE uma obrigação,” this “de” (“das”) refers to incumprimento. The Portuguese is definitely poorly worded here. Should’ve been something like: … poderá resolver o presente contrato por incumprimento grave OU REITERADO das obrigações ... And this “sendo” may be coming from “ou seja” => hence "or" between "material" (for "grave") and "repeated" (for "reiterado").

I think the text first needs to be translated back into ordinary boilerplate. Something similar:
