Hi all,

This phrase appears in the following context:

"A presente contratação é decorrente de Inexigibilidade de Licitação no xxxx, tendo sido autorizada pela xxxx..."

Does this mean that a bidding or tender process took place and was not confirmed and that parties involved decided to enter into this contract- after all if something is "not demanded", it means it is not enforced.....looking for a good way to phrase this if someone has time to assist.

Explanation:
The law, in Brazil, characterizes two possibilities for administrative purchases without a bid tender: dispensa de licitação (bid waiver) and inexigibilidade de licitaçào (non-requirement of bid tender), which is the present case. The bid is not required when competition is unfeasible. The bid is waived, although competition be feasible, whenever the bidding process would be objectively against the public interest, such as: (a)the cost of the bidding process is higher than its possible benefits; (b) the time required may render the contract ineffective; (c) absence of potential benefits from the bidding process, among other cases

Here's what the Brazilian law (Lei 8.666/93)says:

Art. 25. É inexigível a licitação quando houver inviabilidade de competição, em especial:

I - para aquisição de materiais, equipamentos, ou gêneros que só possam ser fornecidos por produtor, empresa ou representante comercial exclusivo, vedada a preferência de marca, devendo a comprovação de exclusividade ser feita através de atestado fornecido pelo órgão de registro do comércio do local em que se realizaria a licitação ou a obra ou o serviço, pelo Sindicato, Federação ou Confederação Patronal, ou, ainda, pelas entidades equivalentes;

II - para a contratação de serviços técnicos enumerados no art. 13 desta Lei, de natureza singular, com profissionais ou empresas de notória especialização, vedada a inexigibilidade para serviços de publicidade e divulgação;

III - para contratação de profissional de qualquer setor artístico, diretamente ou através de empresário exclusivo, desde que consagrado pela crítica especializada ou pela opinião pública.

"Inexigibilidade de Licitação" means that, in the applicable case, a bidding is not necessary. It all depends on the respective regulations. In Brazil, for instance, government entities or agencies can make purchases without bidding processes if the amount involved is lower than a certain value (R$ 8,000.00, if I remember that well). Above such value, all purchases must occur by means of bidding processes.

So, when a bidding is not necessary, there is a Waive of Bidding (Inexigibilidade de Licitação).

Your sentence might be: "The present contracting is entered into pursuant to Waive of Bidding xxxx, having been authorized by xxxx".

agree  Bloomfield: I guess this entry clarifies the question. My answer applies to Dispensa de Licitacao, nao inexigibilidade, which Serodio aptly addressed. Hence, non-requirement seems to be the correct answer. I will enter that in my legal glossary until further notice.
