Tem que haver com a competencia ou isenção de um juiz. Mas como dizer isso em inglês.

judge who has obtained jurisdiction by prevention


Explanation:
from the recently published Moreira de Castro dictionary (better than Chaves de Mello IMHO)
"the judge who first took cognizance of the action obtains jurisdiction by prevention."
The situation is as Mark and Liz described, but I think the wording is perhaps not "asserted" but "obtained by prevention"

All Moreira de Castro's entries under this use "by prevention"

NO NO Noronha. The expanded Chaves de Mello is much better than earlier ones. (red cover 2006 8th "edition"/printing). The new Dictionario de Direito Economia e Contabilidade by Marcilio Moreira de Castro (whose first two editions were privately published) came out in 2010 pub by Forense and Intrans Book Service probably has it in the USA

neutral  MARK ROBERTSON: 1. IMHO the problem with this option is that the reader still may not understand what prevention is. 2. There is a Oct 2008 4th Edition of Chaves de Mello, which is a great improvement, though I have found some inadequacies.
