Portuguese term or phrase: habilitação
Does anyone know the boilerplate English for this term in this context? I have thought it might be "documentation" or "qualifications", but I am not sure of either of these.

This is an extract from case law covering jurisdiction of courts. This Portuguese is from East Timor.

I will be most grateful for help.

Here is context:

Inventário e "habilitação"
1. O tribunal do lugar da abertura da sucessão é competente para o inventário e para a "habilitação" de uma pessoa como sucessora por morte de outra.
2. Aberta a sucessão fora do país, observar-se-á o seguinte:
a) Tendo o falecido deixado bens em Timor-Leste, é competente para o inventário ou para a habilitação o tribunal do lugar da situação dos imóveis, ou da maior parte deles, ou, na falta de imóveis, o lugar onde estiver a maior parte dos móveis;
b) Não tendo o falecido deixado bens em Timor-Leste, é competente para a "habilitação" o tribunal do domicílio do "habilitando".
3. O tribunal onde se tenha procedido a inventário por óbito de um dos cônjuges é o competente para o inventário a que tiver de proceder- se por óbito do outro, excepto se o casamento foi contraído segundo o regime da separação; quando se tenha procedido a inventário por óbito de dois ou mais cônjuges do autor da herança, a competência é determinada pelo último desses inventários, desde que o regime de bens não seja o da separação.
4. No caso de cumulação de inventários, quando haja uma relação de dependência entre as partilhas, é competente para todos eles o tribunal em que deva realizar-se a partilha de que as outras dependem; nos restantes casos, pode o requerente escolher qualquer dos tribunais que seja competente.

Explanation:
This "habilitação" is "habilitação de herdeiros", a document that sets out the shares to which the beneficiaries of the estate of a deceased person are entitled.

"Recommendation 4 (on the European certificate of inheritance). The European Parliament considers that the prospective instrument must aim to simplify the procedures to be followed by heirs and legatees in order to gain possession of the property (...)"

Explanation:
I agree with Martin that "habilitação de herdeiros" is the context, but take the view that the best translation of this term is "entitlement of heirs". There is an existing (pt-en) KudoZ entry for this term, which confirms my view (see below), but there is a Dutch - English KudoZ entry,which supports Martin's view although it does propose entitlement of heirs as an alternative. The advantage of Martin's term is that it is used in the context of some efforts to standardise some inheritance procedures within the EU. The advantage of my proposal is that its meaning is immediately clear.
