Estas audiências são registradas em documento, o que, em linguagem jurídica se chama reduzir a termo. E estes termos invariavelmente começam com a expressão "aos costumes disse nada" (se a testemunha não for parente, amigo íntimo etc do autor ou do réu) ou "aos costumes disse ser pai do Réu" (se for esta a relação da testemuna com o réu).

Veja:
Assim, a frase completa é «Prestou o juramento legal e aos costumes disse nada», o que significa que jurou dizer a verdade e declarou ao tribunal que não tinha qualquer parentesco, afinidade especial ou conflito em relação a nenhuma das partes. Se o tiver, então isso terá de ficar registrado nos autos, e já não se escreverá a expressão «disse nada», mas, por exemplo, «disse ser tio do réu».
