Définition :
C'est une charge imposée sur un héritage pour l'utilité d'un autre héritage appartenant à un propriétaire différent. Il y en a trois grandes catégories : 1) Celles qui dérivent de la situation des lieux. 2) Celles qui sont établies par la loi. 3) Celles qui sont établies par le fait de l'homme. Quand ces servitudes sont établies pour l'usage d'un certain héritage, elles sont dites rurales, qu'elles soient situées à la ville où à la campagne. Les servitudes sont des droits immobiliers réels et font partie du fonds lui-même à titre de valeur. (cela n'est vrai bien sûr que pour le propriétaire du « fonds dominant »). Les servitudes peuvent être rachetées avec l'assentiment du propriétaire du fonds dominant.
