In aceste cazuri, contractul se desfiinteaza de plin drept fara a mai fi necesara punerea in intarziere a BENEFICIARULUI, fara a fi necesara interventia instantelor judecatoresti si fara orice alta formalitate prealabila, prezenta clauza constituind un pact comisoriu de grad IV.

COMMISSOʹRIA LEX is the term applied to a clause often inserted in conditions of sale, by which a vendor reserved to himself the privilege of rescinding the sale, if the purchaser did not pay his purchase-money at the time agreed on. The lex commissoria did not make the transaction a conditional purchase; for in that case, if the property were damaged or destroyed...

Gradul (I, II, III sau IV) se referă la motivul care determină încetarea contractului.

Nu ştiu dacă e potrivit ca în traducere să apară gradul IV, probabil că ar trebui găsită o formulare din care să reiasă că în acest caz este vorba de executarea debitorului.

d) Pactul comisoriu de gradul IV este acea clauza contractuala in care partile prevad ca in cazul neexecutarii obligatiilor, contractul se desfiinteaza de plin drept, fara punerea in intarziere a debitorului. Suntem in prezenta celui mai energic pact comisoriu expres. Ajungerea la termen a obligatiei neexecutate are ca efect rezolutiunea contractului de plin drept. Instanta nu poate decat sa constate rezolutiunea. Totusi, creditorul poate opta intre rezolutiunea de plin drept a contractului si obligarea debitorului la executare.
