| | summary judgement | Explanation: Investirea cu formula executorie a cambiei constituie o procedura de control formal, care nu repune in discutie fondul pricinii, motiv pentru care legiuitorul a inteles sa-i confere caracter necontencios, preocupat fiind de asigurarea celeritatii, esentiala in faza executarii silite. Situatia este similara cu aceea a investirii unei hotarari judecatoresti definitive cu formula executorie, pentru care de asemenea nu a fost considerata necesara prezenta tuturor partilor litigante.

Summary judgment is properly granted when the evidence in support of the moving party establishes that there is no issue of material fact to be tried. (Code Civ. Proc., section 437c; Mann v. Cracchiolo (1985) 38 Cal.3d 18, 35.) The court is required to consider all the evidence set forth in the papers, except where objections are properly sustained, and all inferences reasonably deducible from such evidence. Any doubts as to the propriety of granting the motion must be resolved in favor of the party opposing the motion. (Asare v. Hartford Fire Ins. Co. (1991) 1 Cal.App.4th 856, 862.) If the court determines there is no triable issue of fact, the court will determine any remaining issues of law. (Pittelman v. Pearce (1992) 6 Cal.App.4th 1436, 1441.)

summary judgment
A final decision by a judge that resolves a lawsuit in favor of one of the parties. A motion for summary judgment is made after discovery is completed but before the case goes to trial. The party making the motion marshals all the evidence in its favor, compares it to the other side\'s evidence, and argues that a reasonable jury looking at the same evidence could only decide the case one way--for the moving party. If the judge agrees, then a trial would be unnecessary and the judge enters judgment for the moving party.
