Reclamantul având cuvântul anunţă că renunţă la cererea de partaj astfel cum a fost precizată. Instanţa pune în vedere reclamantului să achite pentru partaj bunuri comune taxă de timbru ... şi timbru judiciar (...). Pârâtul precizează că nu înţelege să timbreze cererea, motiv pentru care intanţa invocă excepţia netimbării cererii de partaj bunuri comune.
