Law/Patents - Law: Contract(s) / Contract
Russian term or phrase: see phrase
From the section of a contract relating to force majeure. The previous chunk sets out the standard exceptions that constitute force majeure. It then goes on to say:

В противном случае сторона испытивающая действие таких обстоятельств теряет право ссылаться на них как на неопредолимые.

I am sure I'm being stupid here, but it doesn't quite make sense to me.

English translation:Otherwise force-majeure cannot be claimed
Explanation:
Otherwise, the Party in relation to which such circumstances have come into existence shall no longer be entitled to claim them as force-majeure.

I'm sure my sentence can be cleaned up and made to sound more polished and formal. But the sense is that otherwise (usually, if they have not reported the force-majeure event in due time or not substantiated it with documentary proof), the Party cannot resort to force-majeure.

Hi Dan, having a good time? Happy Boxing Day.
