Nadezhda's variant would in fact be a more appropriate rendering, i.e. Тitle/deed to the property instead of ownership of the property.

Is there an issue in using "subject to" here? My understanding is that it can be used meaning "being dependent or conditional upon something". Am I missing anything?

Данный термин означает скорее "имущество". Когда Вы говорите о праве собственности, необходимо употреблять термин "title" или ("на худой конец") "ownership".

В Вашем контексте данное словосочетание использовать не стоит :) Вообще, можно пробовать искать английские термины и предложения через Google в расширенном поиске с указанием сайтов поиска .co.uk (например) и уже смотреть по результатам и контексту что выходит. Если результатов "0", то велика вероятность, что термины использованы некорректно.
