damages sustained

Можно сказать, чтобы отличить судебного определения этой суммы от внешней реалии "percentage of the amount of damages [actually] sustained..."

You're misreading it. "Damages attempt to measure in financial terms the extent of harm a plaintiff has suffered because of a defendant's actions." Pretty straightforward. It's just the first reference I opened. "Damages ACTUALLY sustained" is inarguable in its meaning.

You're still looking for legal language; I don't think you WANT the source you're asking for. You want legal/court language specifying actual damages. Anything else would be inappropriate fo your purposes.

Look at this clause. It's clearly talking about damages as actual loss resulting from real-world situations.

No court mentioned.

And look here at the exact phrase I proposed - "damages actually sustained":

Asker: Yes, very straightforward indeed. Particularly taking into account the fact that your definition mentions a plaintiff and a defendant :). Which actually proves my point: whenever damages are mentioned, the court is always involved. There is no legal action in my case.

Asker: But I will still be very grateful for a link to a definition of damages without any reference to court.

Asker: Consequential Damages Injury or harm that does not ensue directly and immediately from the act of a party, but only from some of the results of such act, and that is compensable by a monetary award after a judgment has been rendered in a lawsuit.

Asker: Actual Damages Money awarded to compensate for actual losses (also called "compensatory damages"). The amount awarded is based on the proven harm, loss, or injury suffered by the plaintiff. This award does not include punitive damages, which may be awarded when the defendant's actions are especially reckless or malicious.

Asker: В любом случае любой вид damages является a REMEDY in tort law. And a remedy, in its turn, is a means of enforcing a right or compensating for loss, damage or injury, especially through a court or other judicial body
