Yukos is a Russian company that was the subject of a
bankruptcy application filed against it in Russia. In the
Russian bankruptcy case, a Russian court appointed a
receiver (the Russian Receiver) to perform certain
duties, including preserving Yukos’s assets. Consistent
with his duties, the Russian Receiver sought and obtained
orders from the Russian court enjoining Yukos and its
management from engaging in certain transactions,
including the sale of certain assets, without the consent
of the Russian Receiver (the Russian Orders).

я решила перевести конкурсное производство как receivership, конкурсный управляющий - bankruptcy receiver, временный управляющий - interim receiver, а внешний управляющий -external administrator. По-моему, будет понятно...:)

конкурсное производство - это стадия БАНКРОТСТВА. То есть термин "БАНКРОТСТВО" включает в себя все эти стадии. Соответственно, говоря "BANKRUPTCY manager/receiver" мы не отражаем специфику указанной отдельной стадии.

Что касается временного управляющего, в мультитране есть версия - interim receiver. Тогда конкурсное производство - receivership, а конкурсный управляющий bankruptcy receiver. Вроде, так будет правильно....:)

Да, это конкурсный управляющий. А почему? Думаю, этот термин подойдет. Например, конкурсное управление - это bankruptcy proceedings, а конкурсный управляющий - bankruptcy manager.

Да, лучше, думаю, выбрать нейтральный вариант - bankruptcy manager. Значит, получается - rehabilitation manager, external administrator and bankruptcy manager. Еще есть арбитражный управляющий, который включает все эти три термина - court-appointed administrator. Вроде должно быть понятно...:)

Мне кажется, имеет смысл следовать терминологии, используемой русскими офисками западных юрфирм (см. все мои ссылки).

Я бы использовала managers или administratrators <-- хотя это мое субъективное мнение. Для американцев, возможно термин "trustee" будет более понятен. Хотя, White and Case (Russian office) being an americal law firm still seem to stick to "managers" rather than using the term "trustees".

Это на Ваше усмотрение, конечно.

обсуждения на эту тему ведутся уже который год :) я использую "arbitrazh (commercial) court" для "арбитражный суд" и arbitration для "третейский суд". Иначе российскую специфику не передать.

С терминами вроде разобралась.Внешний администратор - это external administrator, а конкурсный управляющий - лучше, кажется bankruptcy commissioner или bankruptcy manager, наблюдение - supervision. А вот насчет arbitrazh court, в моем переводе это исправили на arbitration, т.к. arbitrazh - это, мол, русифицированное слово. Спасибо за исчерпывающий ответ и полезные ссылки :)
