Оригинал: Следует отметить, что п.5 является условием кредитного договора(п. 12.9) и его невыполнение грозит банку признанием задолженности проблемной.
Мой перевод: Should be noted that point 5 is term of the loan contract (clause 12.9) and its non-fulfilment threatens recognition of debt receivable as a problem by the Bank.

Explanation:

But you [i]cannot[/i] write "recognition of debt receivable as a problem by the Bank" in a professional translation! I hope you are only practicing.
