es el cobro hecho con la sustentación del sistema judicial; hasta ahora sólo he visto que sea usado en Costa Rica...alguna sugerencia para terminología que use el gobierno de los EEUU para algo similar?? no quiero poner una explicación como law-enforced collection of payment ni nada por el estilo, desearía el término ya hecho. Gracias!!!

Explanation:


If you choose to start judicial collection proceedings, the procedure is as follows.

First of all, your debtor will be sent a written demand, with notification of interest and costs, to make payment within a specific, short period. Should payment not be made, a second dunning letter will be sent to your debtor with a draft summons as his last opportunity to make payment and therefore avoid legal proceedings. In the interim, Inter-Collect will advise you about the possibility of making a pre-judgement attachment, in order to secure the recovery of your debt. Should payment not be made, Inter-Collect will then, in consultation with you, summon your debtor to appear before the competent court. After being summoned, your debtor has three possible courses of action. Firstly, he can pay your invoice, together with the interest and costs.

Secondly, your debtor can put up a defence in the court proceedings or, thirdly, your debtor can fail to appear. If and in so far as a debtor conducts a reasoned defence in or out of court in respect of the claim, as asserted by you, that the outstanding invoices are due and payable, we refer to a contested collection. The difference between uncontested collection and contested collection will be briefly discussed below.
