Nota 3.- Los descubiertos en cuenta corriente y libreta de ahorro se considerarán operaciones de crédito a todos los efectos. Según el artículo 19.4 de la Ley 7/95, de 23 de marzo de Crédito al Consumo, en los descubiertos en cuenta con consumidores la comisión percibida junto con los intereses, no podrán dar lugar a una tasa anual equivalente superior a 2,5 veces el interés legal del dinero.
Esta comisión no se aplicará en los descubiertos por valoración o reiterarse su aplicación en otros descubiertos no pactados que se produzcan antes de la siguiente liquidación de la cuenta
