"El Fondo se establece como un **vehículo abierto por el activo y por el pasivo**"
"El Fondo constituirá un patrimonio separado, carente de personalidad jurídica, **que tiene carácter de abierto en el activo y en el pasivo**".

I guess it means that the Fund is not limited in terms of its assets and liabilities - is there a better way of putting it?

Explanation:
This is just a guess, but it sound to me like they are explaining that the Fund doesn't act like a normal "company" where you have to have assets, liabilities and net worth. Seems like it just moves around with assets and liabilites, being that it isn't established via social contract. Maybe?
