The fund is a UCI, set up as a separate asset without being a legal entity in its own right. However, through its management company, it has the capacity to operate as a business and has procedural legitimacy. In addition, the rights and obligations arising from contractual activities are attributed to the fund itself and not to its shareholders; [the text then continues:]
"los partícipes son los propietarios del fondo pero no pueden ejercer ninguna acción o facultad de dominio o disposición sobre el patrimonio del fondo y, muy especialmente, no tienen acción de división del patrimonio común."
