Para muchos esta figura no tiene posibilidad existir en nuestro derecho pero para otros una muestra clara es el de la herencia yacente ejemplo del patrimonio autónomo, como se sabe la herencia yacente es aquel patrimonio hereditario en que se ignora quién es el heredero, no tiene herederos o los que existían han renunciado a dicha herencia, la cual aparece consagrarán artículo 1060 del código civil vigente.
