Explanation:
Cuando el librado se niega a aceptar una letra cambio, se puede recurrir al protesto que es el acto público por el cual se deja constancia del requerimiento formulado al librado ó al aceptante para que acepte ó pague la letra, y de la negativa de hacerlo. Para ello se prepara una solicitud dirigida a un Notario Público, en la cual se le pide a este funcionario que se traslade al lugar donde se encuentra el librado para que deje constancia de su negativa de aceptar la letra. En la ciudades o pueblos donde no hay Notario, el protesto puede hacerse por intermedio de un juez o de un Registrador.
El protesto es importante porque de no hacerlo, el beneficiario puede perder entonces la posibilidad de exigirle al librador que pague la letra.
Este problema puede eliminarse con la cláusula "sin aviso y sin protesto", incluida en la letra.
Su forma suele ser como lo indica el siguiente ejemplo:
Aceptado para ser pagado sin protesto y sin aviso.
