15/11/2011 09:26:29 a.m. | Jesús Rivero Bertorelli.- Desde el año 1999, el tema de la retroactividad en las prestaciones y pagos de pasivos laborales quedó casi en el olvido. Desde entonces el Estado venezolano adeuda a la masa laboral un monto que resulta casi incalculable.

A continuación una breve cronología de las normativas legales que han intentado mejorar la retribución económica de los trabajadores

1928. Se deroga la Ley de Pensiones.

1989. Entra en vigencia la Ley del Estatuto sobre el Régimen de de Jubilaciones y Pensiones para funcionarios y empleados públicos

1997. Fue publicada en Gaceta la Ley de Reforma Parcial de la Ley Orgánica del Trabajo.

Esta nueva norma ofrece a los trabajadores ventajas como la composición del salario, el régimen de prestaciones sociales y lo relativo a despido injustificado.

Sin embargo esta ley generó una enorme deuda del Estado con los trabajadores: los pasivos laborales. Para ese momento especialistas del BCV, calcularon esa deuda en una banda entre los $10.000 y $25.000 millones

1999. La nueva Constitución obliga al estado a efectuar una reforma de la Ley Orgánica del Trabajo, que ofrezca “un nuevo régimen para el derecho de prestaciones sociales consagrado en el artículo 92 de esta Constitución, el cual integrará el pago de este derecho de forma proporcional al tiempo de servicio y calculado de conformidad con el último salario devengado.”

Forgot to mention that it depends on the usage. In some cases labor benefits would be a good term to use, in others labor debt would fit int he context.
