In other words you could indeed refer to them as cash reserve regulations, but from the perspective of the document it is a question of avoiding the deposit (which has to be made for the purposes of the reserve regulations).

Well, maybe it would make sense from one point of view. From the point of view of the document however it is about avoiding the mandatory deposit which presumably applies to works of art but not buildings.

It is a sui generis meaning of encaje which means you have to make a deposit of 30% when you bring money into the country, in certain cases.

The term 'reserve' applies to the reserves which banks etc. have to maintain. As my link shows, this is a very unusual use of the term 'encaje'.

El 5 de febrero el Banco Central de la República Argentina (el “BCRA”) publicó la comunicación N° A 4901 (la “Comunicación”) que establece nuevas excepciones a la aplicación del denominado “encaje” a los ingresos de divisas en el mercado de cambios por parte de no residentes.

Según lo dispuesto por el decreto N° 616/2005, los ingresos de divisas al mercado de cambios por parte de no residentes en el país, están sujetos a la constitución de “un depósito nominativo, no transferible y no remunerado, por el treinta por ciento (30%) del monto involucrado en la operación, durante un plazo de trescientos sesenta y cinco (365) días corridos”.

La mejor solución para nuestro actual problema, para que XXXXX recupere las inversiones realizadas en el museo, es vender la propiedad a XXX y que el comprador de inmediato alquile el inmueble y las obras de arte XXX. En la escritura de compra, se debería hacer referencia a que el precio incluye también los bienes muebles existentes en el edificio (las obras de arte). En estos términos, las regulaciones argentinas relativas al encaje de cierta porción de los fondos que ingresan al país no deberían aplicar, o sea, evitaríamos la aplicación del encaje por la porción del precio de las obras de arte.

... refers normally to a 'reserve' in financial terms. In this case I am wondering whether in Argentina they use it in the sense of 'withholding' a portion of the funds. Maybe for tax purposes. I hope the rest of the context helps.
