Spanish term or phrase: hubiere procedido con culpa

This little phrase crops up in banking contracts for regular accounts. There are several examples with a Google search for "hubiere procedido con culpa". I think I know what it might mena, but am not sure. Any ideas?

Quote from Cabanellas/Hoague dictionary:
"In civil law, CULPA is the unintentional lack of due diligence, for which the actor is civilly liable in tort. In criminal law, CULPA is the violation of a law without intent or malice for a reason that could or should have been avoided."
So, it looks as if the "librador" ("drawer", i.e. the owner of the cheque book) is on the line if they leave the cheque book lying around where anyone can get their hands on it and forge a cheque.

Clasificación de la culpa por su gravedadEs muy importante la clasificación de la culpa por su gravedad, dado que en muchas ocasiones los contratos eximen de responsabilidad para ciertos grados de culpabilidad. Es habitual la distinción entre:

Culpa grave o lata.
Culpa leve.
Culpa levísima.
En muchos casos la jurisprudencia hace equivaler la culpa grave al dolo. Realmente, no se está haciendo equivaler ambos conceptos pero, en la práctica, y dado que probar la intención es sumamente difícil, se entiende que una culpa grave o muy grave se asemeja demasiado a una actuación intencionada, dado que es difícil comprender que se haya hecho de forma involuntaria.

Hubiera o hubiese es el pretérito imperfecto o pretérito pluscuamperfecto del subjuntivo... mientras que "hubiere" es el futuro perfecto.
Está bien redactado en el texto que se cita.
Respecto a "wilful" forgery... puede que tengas razón... La opción de John es perfecta. Saludos

Definición de Culpa

Infracción de ley cometida libremente y sin malicia, por alguna causa que pudo y se debió evitar. Omisión de aquella diligencia que exija la naturaleza de la obligación o corresponda a las circunstancias de personas, tiempo y lugar. Su presencia genera responsabilidad civil tanto contractual como extracontractual y responsabilidad penal.
