Garantías

Las Garantías ampararán la Deuda Senior y la cobertura de tipos de interés. De forma resumida, las garantías incluirán entre otras las que se exponen a continuación:

A Personal y solidaria de la Acreditada.

B Promesa de hipoteca de la Acreditada sobre todos los activos posibles con poder irrevocable al Agente para constituirla, otorgado en el momento de la firma. La Hipoteca se formalizará a primer requerimiento del Banco Agente, siempre y cuando el RCSD sea inferior a 1.10x, salvo que los Accionistas opten por aportar los fondos propios necesarios para restituir el RCSD hasta o por encima de 1.10x.

C Derecho real de prenda de la totalidad de las acciones que los Accionistas tienen en el capital social de la Acreditada; pignoración de las participaciones y los derechos económicos de la acreditada.
