El “chain of title” se llama “tradición legal” en Venezuela; creo que es en México donde se denomina “tracto registral”.
tracto registral: although the usual term in Venezuela is “tradición legal”, I have also read “tracto registral”, meaning “recorded chain of title”.
El principio general establece que sólo puede vender quien figure como dueño en el Registro de la Propiedad Inmueble, aunque la ley establece algunas excepciones, ésta es una de ellas. Aunque claro está, con determinados requisitos. Es necesario que se haya tramitado la sucesión de la persona fallecida, sabiéndose en consecuencia quiénes son los herederos que deberán firmar el Boleto y la correspondiente escritura. También es necesario que el juez ya haya ordenado que ese bien se "inscriba" a nombre de los herederos, o en su defecto que haya autorizado su venta. De todo ello el escribano deberá dejar constancia en la escritura para que el Registro proceda a inscribírsela. A este tipo de escrituras se las llama "Ventas por tracto Abreviado", porque en el Registro se pasa de la persona fallecida al nuevo comprador, sin inscribirse el inmueble a nombre de los herederos. http://www.webinmobiliaria.com.ar/legales.php3||
