I am confused about this phrase. Do I have it right?

Because "regimen" in the context does not simply mean regulations/law. It means an EU system of some kind. We don't have enough context but if you google wou will find example such as EU agricultural refunds system, EU carbon trading system and many others. These are not "laws" but whole systems of inter-member regulatory bureaucracy. Your statement "a person/country is either subject to X regulations/law or they aren't" is no longer true in the context of today's complex legal realities.

Explanation: I agree that "comunitario" refers to European Community, which has been lowercased because it's used as an adjective - in English we have the luxury of being able to use nouns as premodifiers.
I think it's important to capture the meaning of "regimen" as law or 'legal system'. Otherwise it doesn't make sense.
In the translation, I also think it's important to retain the indefinite article; otherwise the meaning isn't clear - hence:
"The applicant may not be a citizen of a State in the European Union, European Economic Area or Switzerland, or related to *a* citizen of any country subject to Community/the European Union legal system."
Actually, 'European Community' is not entirely accurate, though used throughout the world, because it originaly applied only to the European Coal and Steel Community.

Explanation: This is a tricky word that the Ec itself translates in a number of ways. I'm seen "regime" (I try not to use it), framework (I like it better), scheme (only works sometimes. You could probably say "those that fall within the EC framework" as well. Both European Commission and European Community are notoriously translated as EU without thinking, but I would use community here.
