Spanish term or phrase: función sancionadora
Se trata de un estudio de impacto ambiental y social. Esta parte del texto describe los diferentes organismos encargados de supervisar el cumplimiento de las normas legales y técnicas durante la ejecución del proyecto.

Mi duda está en la traducción de "función" porque en algunas partes me parece que encaja "duty" y en otras "function". ¿Cómo dirían función sancionadora? Penalty duty/function?? No me suena bien :S

"Al OSINERGMIN le corresponden las siguientes funciones:
- velar por el cumplimiento de la normativa...
- fiscalizar el cumplimiento de las obligaciones...
- fiscalizar que las actividades se desarrolen de acuerdo a...

La función supervisora le permite verificar el cumplimiento de las obligaciones legales, técnicas y aquellas derivadas de los contratos de concesión por parte de las empresas/personas que realizan actividades sujetas a su competencia.
La función sancionadora, por su parte, le permite imponer multas y otras sanciones a los administrados que infrinjan las leyes, reglamentos y obligaciones de sus respectivos instrumentos de gestión ambiental."

Explanation:
This is a tough call. Function in your context example and discussion entry could be both when referring to those lists. Either supervisory function or duty but sancionadora as an adjective directly modifying function is very difficult. You're right that penalty doesn't sound right and neither does penalization function/duty.
So my answer basically finesses the term to get at the meaning. I'm not expert but to impose penalties is something you have to have authority to do whereas you could supervise and verify compliance without having the authority to impose penalties and discipline measures.
It would break having one word for functions all the way through your translation but it might be the best solution here. At least a starting point.

Another word in the same vein came overnight: the capacity to sanction, meaning you have the ability to do so and implies the authority to do so. May get you a little closer to the root word, since someone "acting in their capacity as" is roughly the same as "exercising the function of" and/or "performing the duty of ".
Hope this helps and doesn't complicate.
