Esto se refiere a la forma en la que estaran organizados los bienes adquiridos antes y despues del matrimonio. Lo opuesto se llama Separacion de Binees y se refiere a que cada uno de los conyuges es dueño de los bienes que se encuentran a su nombre. En una sociedad conyugal, todo es de ambos.

One of the parts in the statement DOES refer to the fact that the parties in this marriage have been living as a common law couple; however, the term Sociedad Comunal is talking about the legal status of the property within the marriage.

sorry, deswegen slipped through because I saw that you were swiss.
I meant therefore.
I would use common-law marriage only when they formally declare a "concubinato" o "unión de hecho" where it is formally accepted. If they only live together, it is just a union.

I don't think it refers to their common assets, however, if you wish to interpret it that way, you would have to check with the local regulations to see whether it is possible at all for a common-law union to hold a joint marital patrimony. if not, both statements would refer to their union.
